Basic Information

Unless otherwise stated in the following sections, no general personal data will be collected, processed or used for using our websites.
When you access our websites, our servers automatically collect general information. These include the type of web browser, the operating system used, the domain name of the Internet service provider, the IP address of the computer used, the website from which you visit us, the pages you visit, as well as the date and duration of the visit.
This data cannot be used by us to identify each user. On the other hand, we will only statistically evaluate the information and allocate it exclusively to improve the attractiveness, content and functions of our websites.

 

Definition of Personal Data

The General Data Protection Regulation (GDPR) of the European Union defines personal data as follows:
‘Personal data’ means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Legal basis for the collection and processing of personal data:
Should you request permission to process personal data, the legal basis for doing so would be Art. 6 par. 1 letter to the GDPR.
When processing your personal data to fulfil a contract between you and Monlau Centre d’Estudis S.A., the ART should be taken as the legal basis. Art 6 par. 1 letter B GRPD. This also applies to the processing of personal data necessary to carry out pre-contractual measures.
In the event that the processing of personal data is necessary to fulfil a legal obligation applicable to our company, the legal basis shall be the Art. 6 par. 1 letter C GDPR.

If the data processing is necessary to protect a justified interest within our company or that of a third party, and if the interests and fundamental rights and freedoms of the data subject do not prevail over the aforementioned interests, the legal basis for the processing shall be the ART. 6 PA. 1 letter F GDPR.

Data removal and duration of storage:

The personal data of the interested party will be removed or blocked so that it no longer serves the purpose of storage. In addition, data may be stored if provided by the European or national legislator in EU regulations, laws or any other rules to which the data subject is bound. The data shall also be blocked or erased if the storage period provided for in these regulations expires, except if the requirement is to continue to store the data for the conclusion or performance of a contract.

 

Collection and processing of personal data

Personal data will only be collected if provided upon request, e.g. to place an order, request information, provide the service or related activities or register for personalised services. If you send advertising you will be informed of the purpose of the processing and, if necessary, asked for your permission to store the data. Personal data collected on our websites will be used without your consent only to take orders or to process your inquiries. Furthermore, your data will only be used with your consent in a centralised database of customers and interested parties managed under the responsibility of Monlau Centre d’Estudis S.A. You may revoke your consent at any time in the future.
Your data and processing will be protected from access by unauthorised persons. Please note that non-encrypted emails will be protected against unauthorised access.

Your data will not be sold, leased or transferred to third parties in any way other than as described here. The transmission of personal data to public institutions and authorities will only take place in accordance with binding national regulations. Our employees, agents and distributors are obliged by us to maintain the strictest confidentiality.

You can contact us via our email address or the contact form. We will use the personal data you provide in this manner exclusively for the purpose for which you communicate with us.

Information on our contact form that is not necessary to contact us is identified as optional. This information will serve to clarify your inquiry and process it in the best possible way. The provision of this information will be explicitly voluntary and with your consent. User Portal

You have the possibility to register on our school platforms, which can be accessed from the website, and to create a user account. We will collect and store your data for registration purposes.

Once registration is completed, you will receive a personalised password-protected access where you can access and manage your information. Registration will be voluntary, but may be a condition for using our services/platforms.

 

Data transfer to external service providers (processing managers)

Your data will be provided to external service providers entrusted by us who support MONLAU CENTRE D’ESTUDIS S.A. in the provision of their services.
The processing of your personal data by the relevant service providers will be carried out in the processing of the order in accordance with ART. 28 GDPR.
These service providers will only have access to the personal information needed to carry out the relevant activity. These service providers will be prohibited from transmitting your personal information or using it for different purposes, especially for advertising purposes.
In the event that external service providers access your personal data, we will ensure through legal, technical and organisational measures and regular checks that they also comply with the applicable regulations regarding data protection.
Your personal data will not be transferred to other companies for commercial purposes.

When we collect personal data through website optimisation tools, we refer to our legitimate interest according to Art. 6 par. 1 letter F of the GDPR in conjunction with item no. 47. Likewise, we only use a pseudonymised tracking system.

Right of access according to Art. 15 of the GDPR

You can request confirmation of whether we process personal data concerning you. In case you have processed your data, you will have additional information rights according to art. 15 of the GDPR.

Right of rectification

If the data you have collected is incorrect or incomplete, you may request it to be rectified without delay, in accordance with Art. 16 of the GDPR.

Right to restrict processing

In accordance with the provisions of Art. 18 of the GDPR, you may request in certain circumstances to restrict the processing of your personal data.
According to the restriction, your data may only be processed with your consent or in order to assert, exercise or defend the legal rights or to protect the rights of another natural or legal person or for reasons of important public interest for the European Union or a Member State. Before the restriction is withdrawn, you will be duly informed.

Right to cancellation

In case one of the reasons prevails according to the Art. 17 par. 1 of the GDPR, you may request the immediate cancellation of your personal data, unless there is an exception to the obligation to cancel in accordance with Art. 17 par. 3 of the GDPR.

Right to notification

If you have exercised the right to rectification, cancellation or restriction of processing, we will be bound by Art. 19 of the GDPR to notify all recipients of personal data, unless notification is impossible or requires a disproportionate effort. You will also have the right to be informed of the recipients before the controller.

Right to data portability

Furthermore, according to Art. 20 of the GDPR, you have the right to obtain from us your personal data in a machine-readable form and to transfer the data to another data controller without any objection, as long as the requirements of Art. 20 par. 1 letter A of the GDPR are met, or to request that your personal data be transferred directly to another data controller, as long as this is technically feasible and does not prejudice the rights and freedoms of other persons. This right does not apply to the processing of personal data necessary for the performance of a public interest task or the exercise of official authority.

Right to opposition

You have the right to object at any time to MONLAU CENTRE D’ESTUDIS S.A.’s processing of your data, in accordance with Art. 6 par. 1 letter F of the GDPR.
We will stop processing your personal data, except if there are reasons that justify the protection of your interests, rights and freedoms or if the processing serves to assert, exercise or defend legal rights.

Right to revoke statement of consent according to data protection regulations

You have the right at all times to revoke your statement of consent in accordance with the data protection regulations by making a statement to MONLAU CENTRE D’ESTUDIS S.A. The revocation of the authorisation will not affect the legality of the processing carried out by virtue of the authorisation until it is revoked.

Right to complain to the supervisory authority

Without prejudice to any other administrative or judicial remedy, you shall at any time have the right to file a complaint before a supervisory authority, in particular in the Member State of your place of residence, your place of work or the place of the alleged breach, if you consider that the processing of your personal data is in breach of this Regulation.
